Sutton, his uncle James Dellinger and Griffin had gone out for a debauched night of drinking on February 21, which turned nasty when a fight broke out, according to court records obtained by Sutton, who has been on death row since he was convicted of the 1992 murders of brother Tommy Griffin and his sister Connie Branam.
Griffin was left shirtless and crouching on the side of the road and was picked up by officers who took him into custody for public intoxication, records show. Sutton and Dellinger extradited him and about half an hour later, witnesses reported hearing three shots, after which Griffin was later found dead with a gunshot wound to the head, records show.

Sutton – who has maintained his innocence – does not have a new execution date in the new year, and it is unclear when the state of Tennessee will resume executions.
